Judge Thomas Newinski Handed Down a Punishment That Fits on a Fast Food Receipt
Brock McNerney is 72.
His wife Moisette is 69.
On the night of January 25, the retired financial planner and his retired special-education-teacher wife crept up to the Republicans of Wheeling Township office in Arlington Heights, Illinois, armed with permanent markers and, police say, feces.
They scrawled swastikas across the windows.
They smeared profanity next to them.
And they drew directly over a portrait of Charlie Kirk – a portrait hanging in the same building where Kirk once volunteered as a teenager.
This week, Cook County Judge Thomas Newinski decided what that was worth.
Eighteen months of court supervision.
A hundred hours of community service.
A hundred dollar fine.
And a court-ordered apology letter.
That's it.
That's the entire price tag for drawing Hitler's symbol across Charlie Kirk's face.
Illinois Prosecutors Have Filed Felony Hate Crime Charges Over Far Less Than What the McNerneys Did
Here's what makes Newinski's sentence impossible to defend.
Illinois has a felony hate crime statute on the books specifically for this kind of conduct.
Prosecutors have used it before – for less.
A Naperville man was charged with two felony hate crime counts – a Class 4 felony – for putting swastika stickers on a county board candidate's campaign signs.
A Wheeling man was hit with a felony hate crime charge and felony institutional vandalism for spray-painting seven swastikas on a suburban church he used to attend.
Neither case involved a murdered political figure's memorial.
Neither target had any connection to an actual assassination.
Yet Brock and Moisette McNerney walked into a courtroom with the same symbol drawn over Charlie Kirk's portrait, and prosecutors never even filed a hate crime charge.
They pled to misdemeanor property damage and defacement.
Newinski signed off on it without blinking.
The Pattern Is Bigger Than One Illinois Courtroom
This isn't an isolated soft touch.

Wheeling Township Republican Committeeman John Saletta said his organization is still waiting on the apology letter Newinski ordered.
He said the people in his organization deserve that much.
He's being generous.

Brock and Moisette McNerney won't spend a single night in jail.
They'll write a letter, do their hundred hours, pay their hundred dollars, and go back to whatever retirement they were living before January 25.
