Judge Andrew Napolitano’s advice to Kavanaugh could end The New York Times



The New York Times is in hot water after being forced to retract outright lies relating to Justice Brett Kavanaugh.

Beyond simply losing credibility, the paper could end up in serious trouble.

And Judge Andrew Napolitano gave Kavanaugh advice that could end The New York Times.

During a recent “Fox & Friends” segment, network legal analyst Judge Andrew Napolitano questioned whether Justice Brett Kavanaugh could sue The New York Times.

Napolitano claims that, if The Times knowingly posted false information, as it appears they may have, then Kavanaugh has a serious case.

After all, they did publish a story detailing a new sexual misconduct allegation and then quickly retracted the most serious parts of it.

Tuesday on Fox News Channel’s “Fox & Friends,” network legal analyst Andrew Napolitano posed the question asking if Supreme Court Associate Justice Brett Kavanaugh could sue The New York Times if an essay it published alleging he engaged in sexual misconduct was knowingly false.

Napolitano said if the circumstances were correct, he would have a case. However, he predicted it would not happen.

“Here’s an interesting one: Can Justice Kavanaugh sue The New York Times?” Napolitano said. “We know the standard is actual malice. Actual malice means did The New York Times publish something they knew was false, or did they publish it in reckless disregard to whether it was true or false? Is leaving out of the article the true statement that the victim does not recall this alleged event reckless disregard for the truth? He may actually have a case there. However, this is not going to happen. He doesn’t want to sue The New York Times. That’s going to open up pandora’s box for him.”

If Kavanaugh is able to prove they knowingly lied about him in order to push harmful allegations, it will forever tarnish The New York Times.

This entire debacle has already destroyed much of the credibility they had left.

A lawsuit could be what ultimately destroys them for good.

      I know he should but it would not be good for him to do so. They should be forced to retract what they wrote and put in the part they left out about the girl not remembering such an incident.       I agree. I can remember, growing up, the standards the paper had about only publishing truth and facts. Now you can bet your last dollar if THEY are printing a story it won’t be vetted, factual or truthful. Papers USED to be held to accountability for what they printed. I’ve seen gossip rags with more accurate information than the Times now issues!

    If the kid from Covington, KY cannot prove to a court that all the lies about him, all the calls to physically harm him, and all the demands for colleges to not admit him were to push harm to him, then how does “Oops we made a simple mistake” finish off the Times? I believe Justice Kavanaugh should sue; however, that does not seem to be the type of man he is. Look at the onslaught of hate and vulgarity lobbied at him for days. When he had finally had enough abuse he verbally fought back. Yet when he finally did, the left pointed at his reaction as not Supreme Court Justice worthy. Although I do not know him, Brett Kavanaugh, the man, seems to be quite worthy of being a Supreme Court Justice. I don’t even agree with all of his votes, but that is not the qualifying factor, which the left cannot understand. Watch the left quickly deflect to another lie that doesn’t stick after the lie before it doesn’t stick. They are nothing short of evil. Remember their mantra, “by any means necessary.” They do not care who they harm nor how they harm them. The left just has to make sure they take down the target.

    One argument being made as to why Justice Kavanaugh is not suing the NY Times AND specifically the Editors for maliciously leaving out the exculpatory phrase is that he may feel that he will have to recuse himself when the case reaches the Supreme Court, thus resulting in a 4-4 null decision. In this case, where a no-longer respected Newspaper of Record” knowingly slanders a sitting Justice, I would allow Kavanaugh to remain in Judgement, and even if he were to recuse himself it is not a given that liberal Justices such as RBG and Sotomayor would automatically vote to allow the slander of one of their own.

    It is my opinion that JUSTICE should prevail if there is legal precedence/merit for the situation. There is probably enough history of similar actions that, legal accountability is justified.

New undercover videos from Project Veritas show just how much CNN hates President Trump.

Employees at the network spoke candidly about how they are unfair to Trump, with one employee even joking about killing the President.

And, using these videos, Donald Trump’s re-election campaign just sent a letter announcing a lawsuit against the network, demanding a “substantial payment” for their wrongful conduct.

Breitbart News reports:

President Donald Trump’s re-election campaign has vowed to file a lawsuit against CNN and is seeking a “substantial payment” in the wake of a series of undercover videos showing bias against the Republican president inside the network.

“Never in the history of this country has a president been the subject of such a sustained barrageof unfair, unfounded, unethical and unlawful attacks by so-called ‘mainstream’ news, as the current situation,” Trump lawyer Charles Harder writes to CNN President Jeff Zucker and Executive Vice President David Vigilante.

“Accordingly, my clients intend to file legal action against you, to seek compensatory damages, treble damages, punitive damages, injunctive relief, reimbursement of legal costs, and all other available legal and equitable remedies, to the maximum extent permitted by law,” the letter continues.

“Please contact the undersigned to discuss an appropriate resolution of this matter, which would include a substantial payment of damages, as well as all other appropriate measures that are necessary to fully address the magnitude of the situation,” it adds.

This week, Project Veritas released several videos featuring CNN employees decrying the network’s coverage in the Trump era as well as audio of Zucker pushing staff to vigorously cover the House Democrats’ impeachment inquiry into the President.

In the videos, CNN outright admits they lie about President Trump.

He has a strong case against them in that regard.

Carlson — who featured Kelly across multiple segments in her first appearance on cable news since she left NBC — also netted 689,000 viewers in the advertiser coveted 25-54 demographic, beating out his closest competitor – Sean Hannity – in both categories for Wednesday night.

Kelly’s multi-segment interview made news on several fronts.

The former Fox News anchor said there should be an independent investigation into allegations the network covered up female staffers’ complaints that former “Today Show” host, Matt Lauer, sexually assaulted them.

Kelly also discussed how she sees the media turning into open political activists, instead of journalists during the Trump era, putting to lie claims by the Fake News Media that journalists don’t take sides.

If this interview was an audition for a comeback at Fox News, Kelly likely passed with flying colors.

The controversial Kelly proved she was a ratings draw and the Fox News Channel viewers were still interested in what she had to say.

While there are no current openings at Fox in primetime, the channel has shown in the past they will make changes to strengthen their lineup.

On Wednesday night Kelly made her return to Fox News.

And in a shocking interview Megyn Kelly told Tucker Carlson one fact about CNN that no one saw coming.

Megyn Kelly made major news in her first sit-down interview since being fired by NBC last fall.

In her interview with Tucker Carlson, Kelly addressed the tapes released by Project Veritas where a CNN whistleblower revealed Jeff Zucker demanded the network push impeachment 24 hours a day and seven days a week.

Critics saw Zucker as trying to push the story toward a favored conclusion – impeaching Donald Trump – instead of letting the facts dictate the coverage.

But Kelly defended Zucker.

Kelly told Carlson impeachment was a big story that demanded massive coverage.

Carlson referenced CNN and comments from network head Jeff Zucker regarding CNN’s coverage of President Donald Trump’s so-called impeachment inquiry. Kelly replied in defense of Zucker and CNN but added the media and Democrats had hurt their own cause by making everything about Trump a “hyper-focus.”

“I mean, impeachment is a big story,” Kelly said. “If the president of the United States is going to get impeached and possibly bounced out of office, it’s a major, major story. So, I think that’s defensible on the part of Jeff Zucker, but I do think the hyper-focus on by most media at the expense of all else is not new, right? Since the day Trump got into office, they have been hyper-focused on impeachment. This is the problem the Democrats, and to some extent, the media, is up against — it was the 25th Amendment, the Emoluments Clause, Russia, Russia, Russia, obstruction of justice — all of those things, he had to be impeached. If everything is an 11, nothing is an 11.”

“So now, they may have actually stumbled upon an 11,” she continued. “They got the transcript, whatever. Trump said it was a perfect call. You can make an argument. But no one is paying as much attention as they otherwise would have if he hadn’t been told from the beginning that he needs to be bounced out of office. They can ratchet up the coverage all they want, but I don’t know they’re convincing anyone that was on the fence or in the middle.”

Kelly did not think that the Fake News Media and the Democrats wanted to impeach the President from day one.

And she ran through all the crazy and manufactured scandals the Democrats previously used to justify investigating the President.

Many were surprised to see Kelly hedging her bets on this topic.

But she could have been trying to preserve her ability to work in “straight news” if she decides to make a full-time comeback.
